Terms of service
Last updated: 7 September 2026
1. Scope and provider
These General Terms and Conditions ("Terms") govern all orders placed through this online shop (the "Shop"), operated by Nathan Melliger, trading as Kimura Fighting, Flüelastrasse 16, 8048 Zürich, Switzerland ("we", "us"). By placing an order you accept these Terms in the version in force at the time of the order. We do not accept any conflicting terms of the customer.
2. Customers
The Shop is aimed at customers aged 18 or over. Some products are combat-sports training equipment intended for use by adults or by minors under the supervision of a responsible adult.
3. Conclusion of the contract
The presentation of products in the Shop is not a binding offer but an invitation to the customer to submit an offer. By clicking the order button and completing checkout you make a binding offer to purchase the items in your cart. We may accept that offer by sending an order confirmation or by dispatching the goods. An automated acknowledgement of receipt does not constitute acceptance. We may decline an order, for example if an item is no longer available or a pricing error is obvious.
4. Prices and payment
All prices are stated in Swiss francs (CHF). As a small enterprise below the CHF 100,000 turnover threshold we are not registered for Swiss VAT; prices contain no VAT. Shipping costs are shown separately before you confirm the order and depend on the destination and the size and weight of the shipment.
Payment is made using the methods offered at checkout. Payment is processed by our payment service providers; the full purchase price is due at the time of the order. We remain the owner of the goods until the purchase price has been paid in full (retention of title, Art. 715 of the Swiss Civil Code).
5. Delivery
We ship from Switzerland to Switzerland and to the international destinations listed at checkout, using Swiss Post. Stated delivery times are estimates and non-binding. Within Switzerland, orders usually arrive within 1–3 business days of dispatch. Details are set out in our Shipping Policy, which forms part of these Terms.
The risk of accidental loss or deterioration of the goods passes to the customer on handover of the goods to the customer or, where the customer is not a consumer, on handover to the carrier.
At checkout the customer selects the shipping service. Where the customer chooses an option without tracking, Swiss Post provides no evidence of posting or delivery; we are then unable to trace the shipment and cannot replace or refund an order that is reported not received. By choosing the cheaper untracked option the customer accepts this risk. A tracked option, and a signature-on-delivery option, are offered for every order.
For deliveries outside Switzerland, any customs duties, import taxes and handling fees are borne by the customer and are not included in our prices or shipping charges.
6. Returns and exchanges
Swiss law does not provide a statutory right of withdrawal or cancellation for online purchases. As a goodwill gesture we nevertheless offer a voluntary return right; the conditions, deadlines and excluded items (in particular opened hygiene products) are set out in our Refund Policy, which forms part of these Terms.
7. Warranty for defects
The statutory warranty rules of the Swiss Code of Obligations (Art. 197 et seq.) apply. The customer must inspect the goods within a reasonable period after receipt and notify us of any defect without delay (Art. 201 CO). The limitation period for warranty claims is two years from delivery (Art. 210 CO). In the event of a defect we will, at our discretion, repair or replace the item or refund the price; if we deliver the wrong item we bear the return and replacement shipping costs.
Normal wear and tear, damage caused by improper use, inadequate care, or use that does not match the intended purpose of the product are not defects.
8. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and where liability is mandatory (in particular under the Swiss Product Liability Act). In all other cases our liability for slight negligence is excluded. In particular we are not liable for indirect or consequential damage, nor for injury or damage resulting from training with, or improper use of, combat-sports equipment. Combat sports carry an inherent risk of injury; customers train at their own responsibility and should seek qualified instruction.
9. Data protection
We process personal data in accordance with our Privacy Policy and the Swiss Federal Act on Data Protection (FADP).
10. Governing law and place of jurisdiction
These Terms and all contracts concluded under them are governed exclusively by Swiss substantive law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and of conflict-of-law rules. The place of jurisdiction is Zürich, Switzerland. Mandatory places of jurisdiction for consumers remain reserved.
11. Final provisions
Should any provision of these Terms be or become invalid, the validity of the remaining provisions is not affected. We may amend these Terms with effect for future orders; the version published in the Shop at the time of an order applies to that order.
